Cenni sul delitto di tortura alla luce dei recenti orientamenti giurisprudenziali

L’articolo tratta del delitto di tortura, introdotto nel codice penale a opera della L. n. 110 del 14 luglio 2017, in attuazione della Convenzione internazionale contro la tortura e le altre pene o trattamenti crudeli, disumani o degradanti, adottata dall’Assemblea Generale dell’ONU il 10 dicembre 1984, ratificata dall’Italia con la L. n. 498 del 3 novembre 1988. In particolare, il presente lavoro si soffermerà sulla descrizione degli elementi costitutivi previsti dalla fattispecie penale incriminatrice, anche alla luce delle pronunce rese sul punto dalla Corte di Cassazione.
Inoltre, saranno esaminate le questioni interpretative su cui si sono soffermate la dottrina e la Suprema Corte, nonché i rapporti con il delitto di istigazione del pubblico ufficiale a commettere tortura e con altre ipotesi delittuose rispetto alle quali si pone il problema del concorso tra reati. Ci si soffermerà, infine, sugli aspetti processuali relativi al reato in esame, tenuto conto anche delle modifiche e delle novità apportate proprio con l’introduzione del delitto di tortura.

The article deals with the crime of torture, introduced into the penal code by Law no. 110 of 14 July 2017, implementing the International Convention against torture and other cruel, inhuman, or degrading treatment or punishment, adopted by the UN General Assembly on 10 December 1984, ratified by Italy with Law no. 498 of 3 November 1988. This work will focus on the description of the constituent elements foreseen by the incriminating criminal case, also considering the rulings made on the point by the Court of Cassation.
Furthermore, the interpretative issues on which the doctrine and the Supreme Court have focused will be examined, as well as the relationships with the crime of incitement of a public official to commit torture and with other criminal hypotheses in relation to which the problem of complicity between crimes arises. Finally, we will focus on the procedural aspects relating to the crime in question, also considering the changes and innovations brought about with the introduction of the crime of torture.
